Terms & Conditions

This agreement is made on the date set out below between the Subscriber (specified in this Application) and QuotePartner Limited hereafter referred to as Quote Partner.

1. The signatory of the Subscriber below confirms they have the authority to enter into this Agreement and the details provided within the Application are accurate and that all relevant information has been disclosed. The Subscriber may change its company information and business sectors described in this Application after the details have been enabled without charge. Should this application be refused Quote Partner is under no obligation to give the reason for the refusal.

2. Definitions of terms contained in this Agreement:
User - The person or company who uses www.quotepartner.co.uk or other Site and who may then make a Quote Request.
Subscriber - Any business wishing to use Quote Partner to generate business leads.
Site - www.quotepartner.co.uk or a registered partner of Quote Partner
Form - Online form allowing the User to register a Quote Request by submitting their criteria.
Job Leads - The criteria data submitted by a User which is matched to the Business Sector, geographical Job Distance and Lead Type
Invalid leads - Where a User has submitted false or misleading data via the Form.

3. The Subscriber requires that Quote Partner supply Job Leads for the nature of business specified in the 'Business Sectors' part of this agreement, the geographical areas specified under the 'Job Distance' part of this agreement and the Lead Type as specified as part of this agreement.

4. Quote Partner undertakes to ensure that the selection of Subscribers is made independently and impartially according to the suitability of the products and services offered by the Subscribers and the requests made by the User.

5. Whilst every effort is made to assess the User and their request via the Site the Subscriber nor the User agrees not to hold Quote Partner responsible for false information and/or quotation requests passed on to the Subscriber nor for any consequential damages that result, whether direct or indirect.

6. Quote Partner's sole obligation is to put the User in contact with the Subscriber. Quote Partner will not intervene in any subsequent negotiations between the User and the Subscriber and will under no circumstances be held responsible for any disagreement that may occur between them during the negotiations and/or the provision of products or services.

7. Quote Partner agrees to only send the same Job Lead to a maximum of five Subscribers within the first 3 days of a requested quote.

8. Quote Partner declines all civil and/or penal responsibility concerning direct and indirect consequences of the contact between the User and the Subscriber. Quote Partner may not be held responsible in matters concerning the relevance and quality of Job Leads it passes on to the Subscriber.

9. The Subscriber is not obligated to purchase any Job Leads that are sent via email or sms or any other method.  In all cases the job summary, postcode and contact details, as supplied by the User on the Form, will be made available to the Subscriber via email and/or SMS to the Subscribers mobile.  The lead can be ‘purchased’ at the price notified on the email or sms using the instructions given, these being by paying by credit/debit card from an email alert or by reducing a pre-paid account when paying from an SMS alert.  Once payment is made, full details will be sent by email to the Subscribers email address from an originating email alert and by SMS if purchased via SMS alert.

10. Lead prices are determined by the price on an Email or SMS alert. The subscriber has the option to accept and purchase or reject.  Lead Prices may reflect discounts already applied for Trade Association partners or other strategic partners

11. An invoice detailing a purchased Job Lead will be sent by email to the Subscribers address. It is the responsibility of the Subscriber to ensure Quote Partner has the correct details.

12. In the event you have any dispute with regards to a Job Lead, you must contact Quote Partner by email to sales@quotepartner.co.uk within 48 hours of the Job Lead being issued.

13. The Subscriber agrees to the following:
(i) Having up-to-date Public and Employers Liability insurance as appropriate.
(ii) Respond within 3 working days to Job Leads received via Quote Partner even where a negative reply is required.
(iii) Provide a written quotation before work is undertaken.
(iv) Where extra work is required, this excess will be confirmed by the Subscriber to the User in writing.
(v) Provide an invoice that conforms to the written quotation and any subsequent agreed excess.
(vi) Undertake the work on the dates and within the time-scales arranged.
(vii) Respect the current standards of work and employ competent staff.
(viii) Leave the work-site in a clean and tidy state (if applicable).

14. The Subscriber undertakes to provide the User with the best possible service and to complete all work arranged. Quote Partner cannot be held in any way responsible should the Subscriber fail to fulfil any of its obligations to a User.

15. The Subscriber may use the Quote Partner logo to assist in its promotion. In the event that the Subscription is terminated, the Subscriber agrees to cease using and to remove the Quote Partner logo from its promotions immediately.

16. The Subscriber hereby gives its consent to Quote Partner to carry out any relevant searches on any or all individuals or trading styles of their business at any home or business address associated with the company, with any credit reference agency that we deem appropriate. Such credit agencies may keep a record of that search and may share that information with other parties.

17. Both parties shall have the right to terminate this agreement at any time by giving notice in writing to the other party. However if the Subscriber has pre-paid for leads these leads may not be refunded.

18. If any provision in this Agreement should be held to be invalid such provision shall be severed and the remaining provisions shall continue to have full force and effect.

19. This Agreement shall be governed by the Laws of England.

20. This Agreement constitutes the entire Agreement between the Subscriber and Quote Partner and no representation, statement, warranty or condition not expressly contained in this Agreement or incorporated herein by reference shall be binding upon Quote Partner as a warranty or otherwise.

21. Quote Partner reserves the right to change the structure and content of the Site at any moment.
